Terms & Conditions

Please read these Terms & Conditions carefully. By commissioning artwork or using any services from Lemanis Art, you confirm that you have read, understood, and accepted these terms in full.

In this document, “I” and “me” refer to the artist operating as Lemanis Art. “You” refers to the Client. These Terms & Conditions apply to all purchases and custom commissions. It is not necessary for the Client to have signed any document for these terms to apply.

Description of Work:

All portraits are created using high-quality acrylic paints, oil paints, or graphite pencil. Finished pieces are protected from dirt, dust, and UV damage with either a protective varnish or graphite fixative spray, depending on the medium.

Each portrait is based on one or more reference photos provided by the Client. I will work with you to choose the most suitable image. If the photo provided is not suitable for creating a high-quality portrait, I may request an alternative or decline the commission. If the commission is declined at this stage, the deposit will be returned.

Reference Image Rights:

You must either own the reference photo or have written permission from the copyright holder to use it. This includes photos taken by professional photographers. By sending any image to Lemanis Art, you confirm that you have the legal right to use that image and grant permission for it to be used in the creation of original artwork.

Payment Policy:

A $75 non-refundable deposit is required to secure a place in the schedule. This deposit holds a spot that could have gone to another Client. The remaining balance must be paid no later than 30 days before the portrait is delivered or shipped. Invoices are issued via PayPal or other approved methods.

Payment plans are available upon request. The total cost can be divided into multiple monthly payments, with a custom schedule agreed upon in advance. Once work has started on the portrait, any payments made are non-refundable. The artwork will be delivered only after the full amount has been paid.

If the Client is not satisfied with the finished portrait and the issue cannot be resolved through minor edits, the remaining balance will not be required, but the portrait will not be delivered. Prices may change over time, but once the deposit is paid, the quoted rate is secured.

Refunds, Returns, and Cancellations:

All deposits are non-refundable. If the commission is canceled before work has started, no additional payment will be required. If you decide to commission a new portrait at a later time, the original deposit will be applied to the new piece.

Progress photos will be shared throughout the creation process so that feedback can be given and small changes can be requested. Because the artwork is custom, once it is completed and approved, it cannot be returned or refunded unless it arrives damaged.

If the portrait arrives damaged in the mail, you must contact me within 48 hours of delivery. In that case, the Client will be responsible for return shipping if applicable.

Work in Progress and Communication:

You will receive updates and progress photos throughout the creation process. Minor edits can be requested during this stage. I reserve the right to share progress photos on social media or my website, unless you request otherwise (such as for surprise gifts). If the portrait is a gift, images of the finished piece will not be posted until the gift has been given.

Overpayments and Scam Prevention:

If an overpayment is made, the extra amount will be held as store credit for a future purchase. Refunds will not be issued to unfamiliar or third-party accounts. All payments must come from the Client and through an approved payment method.

All communication and transactions must be handled through verified platforms. I will never ask for payments to be sent to another person or account. If any suspicious behavior is detected, such as mismatched names, unverifiable addresses, or payment irregularities, the order may be canceled without refund. Lemanis Art reserves the right to refuse service if fraud or manipulation is suspected.

I retain full copyright to all original artwork created under Lemanis Art. This includes the right to use images of completed work for my website, social media, portfolio, and printed promotional materials.

You may share photos of your portrait for personal, non-commercial use. You may not reproduce, license, sell, or otherwise use the artwork commercially without written permission.

For human portraits, I will always ask permission before sharing images publicly due to privacy considerations.

Privacy and Client Data:

To complete your order, I will collect your name, email address, and shipping address. This information is used only for communication, invoicing, and delivery of your portrait.

Contact information may be securely stored to keep track of past orders and to share future updates, special offers, or new services related to Lemanis Art. If you would prefer not to receive any future communication, let me know and your contact info will be removed from my records.

Any reference photos sent for the commission will be deleted or destroyed once the artwork has been completed and delivered.

Changes to Terms:

These Terms & Conditions may be updated periodically. If you have a current commission in progress, I will notify you of any changes that may affect your order.
